Former Supreme Court Justice Sandra Day O'Connor states on FOX NEWS Sunday, May 20, 2007, that one of the most significant events for America is that the Jamestown Colony brought with them the old English Common Law.

How soon we forget. Jamestown was chartered by a tyrannical King of England in 1607, some 170 years before the Declaration of Independence and the American Revolutionary War. Many of the people who settled in the New World came to escape religious persecution.

In common law legal systems, judges have the authority and duty to decide the law. Once an appellate court has decided what the law is, that precedent binds future decisions of the same appellate court, and binds all lower courts reviewed by that appellate court.

Some of the most hideous common laws in America include judicial immunity, prosecutorial immunity, legislative immunity, stare decisis, diplomatic immunity and sovereign immunity, judicial discretion and best interest of the child.

Judicial Immunity is a form of legal immunity which protects judges and others employed by the judiciary from lawsuits brought against them for official conduct in office.

For example, a judge may not be the subject of a libel suit for statements made about a criminal defendant during a trial. Nor may a judge's clerk be sued for negligence in failing to deliver materials to the judge.

Historically, judicial immunity was associated with the English common law idea that "the King can do no wrong." (Compare Sovereign immunity.) Judges, the King's delegates for dispensing justice, accordingly "ought not to be drawn into question for any supposed corruption, for this tends, to the slander of the justice of the King." Floyd & Barker, 12 Co. Rep. 23, 25, 77 Eng. Rep. 1305, 1307 (Star Chamber 1607).

Judges are capable of grievous abuses against defendants during trials. Judicial immunity allows for judges to make decisions which do not agree with the thinking or sentiment of the people of a country. In the US, judicial immunity has come under attack during several times: the Terri Schiavo case, or during abortion cases, for example. Ron Branson, of California, has introduced J.A.I.L 4 Judges as part of a nationwide effort to strip judges of their immunity.

Old English common law is a product of tyranny and is repugnant to a free society. The ink was not dry on the US Constitution when judges and lawyers began to enforce with vigor the old English common law from whence American colonies fought a major international war to free themselves.

American judicial decisions include the phrase, "There is no such tort in English common law" and many others reference English common law. The phrase occurs many times in American jurisprudence and is a convenient excuse to give judges extreme and tyrannical powers to disregard statute and constitutional law.

O'Connor further states that she is working on a personal web site targeted for children to teach them about America's court system. Will she include in her instruction that she voted to approve abortion and kill babies?

This message will be unpopular with many naive Americans. Am I ashamed to vilify a former supreme court justice? No, a villain is a villain and needs exposure. After years of supporting baby killing, she will continue her carnage on American's children to misinform and brainwash them about her distorted version of how government and the courts should be in a free society. No doubt she will espouse the tyrannical works of Old English Common Law.




Some proponents of common law say, "Common law requires a jury. Equity courts use a judge to declare rights."

However, Common law is "case law" and is no better than equity law. Case laws are decisions of the King. Equity courts are no better than dictators. The system we have with jury trials is good, just leave the King's law out of it. I don't feel like quartering troops in my house today.

American Law is replete with references to old English Common law. For example, "There is no provision in Old English Common Law that allows" a certain position. In this way the American Courts use the English Common Law to deny civil rights in two ways. Because the English Common Law made no provision or the English Common Law said otherwise.

Another example is the tort of wrongful death, which allows certain persons, usually a spouse, child or estate, to sue for damages on behalf of the deceased. But the common law in some states denies father's the right to sue on wrongful death of his child. That right belongs only to the mother. And the common law of those states also sets up the "best interest of the child" standard.

Therein lies the evil of Old English Common Law (any common law for that matter) and its application to American Law. Common law amounts to legislating from the bench.

Associations and the law-school accreditation scheme would go far toward fixing the problems."

Broken people break "things" and the "things" remain broken. Someone must fix it. Regardless the "things" are still broken. Quality people cannot fix the American legal system. Most quality people get caught up in the broken system and are intentionally blind to its problems. The first thing lawyers in Congress would have to do is resign their position based on the Separation of Powers clause of the US Constitution. We know that ain't gonna happen.

The remaining quality people are forced to acquiesce to the broken system. Rather than change the system, the legal profession is fraternally bound to the false notion and morally bankrupt excuse called the "rule of law." Judge-made judicial immunity is the "rule of law."

Not one single person of any caliber will stand up and say, "Okay, this time we will follow the constitution." And that's stating it mildly.

It's time to abolish judge-made judicial discretion and immunity doctrines and $170,000 appointed judges for life. Congress could do the job with a stroke of a pen, but most congressman are lawyers. Judicial reform could not make it past the 37-lawyers in the House Judiciary Committee.

Instead of reforming the legal system, America has digressed and finds the practice honorable to shackle people to stirrups in the public square for unpaid debt. What comes next? Where are these quality people? Is there one good man left, willing to risk it all for his country?

Sandra Day O'Connor is afraid. Interestingly the judges are suddenly afraid of the people. Do we have a government, by the people or by the lawyers (judges). IT is quite obvious we have a government by the lawyers and judges.

Judicial Immunity was never the framers intent in the constitution as claimed by O'Connor. O'Connor is nothing more than another liar intent on protecting a very corrupt monopoly that is slowly destroying America.

Judicial Immunity and all other judicially made immunity laws are NOT in the constitution. They stem from old English common law that declared, "THE KING CAN DO NO WRONG."

I challenge any Fascist judge to show me where in the Constitution is judicial immunity.
