UNITED STATES DISTRICT COURT FOR THE
MIDDLE DISTRICT OF ALABAMA, NORTHERN DIVISION

Pursuant to Fed. R. Civ. P. 25(d)(1), plaintiffs James R. Blackston and Bradley W. Barber, move this Court for an Order: (1) substituting Rich Hobson, as Director of the Administrative Office of Courts as a Defendant and; (2) amending the docket accordingly. The Plaintiffs state in support hereof as follows:

1. Frank Gregory is a defendant in the above styled cause in his, individual and in his official capacity as Alabama's Administrative Director of Courts.

2. According to the defendants' ANSWER, entered on or about January 22, 2001, defendant Frank Gregory retired as Director of the Administrative Office of Courts, as of January 16, 2001. (See Defendant's Answer, p3, n.1)

3. The Honorable Rich Hobson has been appointed as the Director of the Administrative Office of Courts effective, January 15, 2001.

WHEREFORE, the Plaintiffs respectfully request that this Court will substitute Rich Hobson, in his official capacity as Director, Alabama Administrative Office of Courts, in place of Frank Gregory, as the new party-defendant in the above styled case and amend the docket accordingly.
