MOTION FOR CLARIFICATION
Come now the Defendants, Circuit Judge Richard Dorrough. Frank Gregory and Bob Maddox, by and through undersigned counsel, and submit the following Motion for Clarification of the Court's Order dated September 13, 1999. As grounds for said motion, the Defendants state as follows:
1. On June 23, 1999, the Defendants filed a Motion to Dismiss and in the alternative a Motion for More Definite Statement and Motion to Strike.
2. On June 25, 1999, this Honorable Court issued an Order that required the Plaintiffs to file a response and brief in opposition to the Defendants' Motion to Dismiss.
3. On or about July 8, 1999, the Plaintiffs filed a response and brief to the Defendant's Motion to Dismiss.
4. On September 13, 1999, this Honorable Court issued an Order that denied the Defendants' alternative Motion for More Definite Statement and Motion to Strike. However, the Court's order did not address the Defendants' Motion to Dismiss. Undersigned counsel is unclear whether this motion is still pending for consideration by the Court.
5. To the extent the Court has already ruled on the Defendants' Motion to Dismiss, the Defendants respectfully request an extension of seven (7) days from the ruling on this Motion for Clarification in which to file an answer.
WHEREFORE ALL PREMISES CONSIDERED, the Defendants pray that this Honorable Court will grant the Motion for Clarification.
